Hemp, CBD Legalization Bill is Passed by The South Dakota Legislature
A bill has been passed by the legislature of South Dakota legislature legalizing hemp that is expected to be signed by the Governor Kristi Noem.
A similar legislation was disapproved by Governor Noem last year; however, she would sign a hemp bill in January of this year if lawmakers kept on to her “guardrails.”
These guardrails comprised:
- Restriction on smokable hemp
- Inspection and supervision licenses and regulation by the Department of Agriculture and Department of Public Safety.
- The legislation should be self-funding through fees.
- A permit will be required for transporting the hemp.
It was the toughest task to provide funding for the program as legislature and Noem argued about the amount.
Ultimately, a budget of $3.5 million was proposed to launch the program.
If Noem signs the bill, an emergency provision would put it into effect immediately.
After the approval of bill, South Dakota will have to prepare and submit a hemp plan to the US Department of Agriculture for authorization before farmers can start growing hemp.
